ConsentGate terms of service

Version 1.1, effective 12 October 2026

1. Provider and definitions

The ConsentGate service is provided by CRE 8 Sp. z o.o., with its registered office in Warsaw, ul. Wiązana 6D lok. P1, 04-765 Warszawa, Poland, entered in the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw under KRS number 0000321545, tax identification number (NIP) 9522064848, REGON 141710560, share capital PLN 50,000 (the "Provider"). Contact: kontakt@consentgate.eu.

The Customer is a business or other person who creates an account in the panel at app.consentgate.eu. The service is intended for those who run websites and is not directed at consumers.

A Site is a website of the Customer added in the panel.

A person who creates an account on behalf of a company or another organisation confirms that they are authorised to conclude the contract on its behalf.

2. Scope of the service

The service covers: a cookie consent window shown on the Site, passing the visitor's decision to the tools named in the service description, a log of decisions, and a panel for managing settings.

The features and limits depend on the chosen plan described in the price list at consentgate.eu.

The service is a technical tool. The Provider does not give legal advice, and the Customer is responsible for the compliance of the Site with the law.

The Provider keeps all rights to the ConsentGate software. For the term of the contract the Customer receives a non-exclusive, non-transferable right to use the window code on the Sites added in the panel. The Customer may not copy the code to its own server or modify it, unless the plan provides otherwise.

On the free plan the window may carry a ConsentGate mark with a link.

3. Account and technical requirements

Using the service requires an email address, a current web browser and the ability to place code in the head of the Site.

The Customer is responsible for the people given access to the account and for the accuracy of the data provided.

The Customer may not use the service for unlawful purposes or supply unlawful content.

The Provider may suspend an account if the service is used on a site with unlawful content or in a way that threatens the operation of the service. It informs the Customer of the suspension by email and gives the reason.

4. Obligations of the Customer

The Customer places the window code as instructed, as the first script in the head of the Site, and tags scripts that need consent.

The Customer is responsible for the texts, colours and window settings it has changed, and for the content of its own privacy policy.

The Customer is the controller of the data of visitors to the Site. The processing of that data on its behalf is governed by the data processing agreement, which forms part of these terms.

5. Fees

The free plan is free of charge. Paid plans are billed in advance, monthly or yearly, at the price list in force on the day of purchase.

If a paid plan is not paid, the account moves to the free plan after a grace period. The consent window on the Site keeps working.

The Provider may change the price list. A change does not affect a period already paid for.

6. Availability and changes to the service

The Provider makes efforts to keep the service running without interruption but does not guarantee a specific availability level unless the parties agree it separately.

The Provider may develop and change the service. It gives at least 30 days notice of changes that reduce the features of a paid plan.

Support is provided by email at kontakt@consentgate.eu on working days.

7. Liability

The Provider is liable for damage caused to the Customer by wilful misconduct. Otherwise its liability is limited to the total fees paid by the Customer in the 12 months before the event, to the extent permitted by law.

The Provider is not liable for the effects of settings chosen by the Customer or for the operation of third-party tools embedded on the Site.

8. Complaints

Complaints about the service can be sent to kontakt@consentgate.eu. A complaint should include the account email address, the Site address and a description of the problem.

The Provider replies to a complaint within 14 days of receiving it.

9. Term and termination

The contract is concluded for an indefinite period when the terms are accepted in the panel.

The Customer may stop using the service at any time and request deletion of the account. Fees for a period already started are not refunded unless the law provides otherwise.

The Provider may terminate the contract with 30 days notice, or with immediate effect in the case of a gross breach of these terms.

After the contract ends, the Customer may download the consent log and settings for 30 days. The data is then deleted.

10. Changes to the terms and final provisions

The Provider gives notice of a change to the terms by email and in the panel at least 14 days in advance. A new version requires acceptance in the panel. Without acceptance the consent window on the Site keeps working, but publishing changes is blocked.

The contract is governed by Polish law. Disputes are settled by the court competent for the seat of the Provider.
